Terms and Conditions

Welcome to the TML Leads Exchange, an online lead-exchange marketplace operated by Technovators Marketing Limited (“TML Leads Exchange,” “we,” “us,” or “our”). These Terms and Conditions govern your access to and use of the TML Leads Exchange, including the purchase, sale, submission, exchange, and use of business leads.

By accessing or using the website, creating an account, submitting a lead, purchasing a lead, or otherwise using our services, you agree to these Terms and Conditions. If you do not agree, please do not use the website.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use TML Leads Exchange. By using the website, you confirm that the information you provide is accurate and that you have the authority to accept these Terms on behalf of any business or organization you represent.

2. Our Services

TML Leads Exchange provides an online platform that may allow users to:

4. Lead Submission Requirements

You may submit only leads that you have the legal right and permission to submit.

Each lead must contain accurate and current information to the best of your knowledge. You must not submit:

  • Leads belonging to another person without authorization;
  • Leads containing malware, harmful code, or malicious content;

  • Leads generated through spam, scraping, automated abuse, or unauthorized data collection; or
  • Leads that violate applicable advertising, privacy, telemarketing, consumer-protection, or data-protection laws.

You must not represent that the TML Leads Exchange has approved, verified, endorsed, or guaranteed a lead unless we have expressly confirmed this in writing.

5. Consent and Privacy

You are responsible for obtaining all notices, permissions, and consents required before collecting, submitting, sharing, selling, or using personal information contained in a lead.

You must not submit a person’s information unless you have a lawful basis to do so and have provided any required disclosures. Where applicable, you must ensure that individuals understand that their information may be shared with or contacted by relevant businesses or service providers.

You must handle all lead information in accordance with applicable privacy and data-protection laws and our Privacy Policy. You must promptly honor requests to stop contacting an individual and must not use lead information for purposes unrelated to the permitted transaction.

6. Lead Buyers

If you purchase or receive a lead, you agree to:

  • Use the lead only for lawful business purposes;
  • Contact the individual only as permitted by applicable law;
  • Avoid misleading, aggressive, harassing, or deceptive communications;
  • Protect the lead information from unauthorized access or disclosure;
  • Not resell or redistribute the lead unless expressly authorized;
  • Honor opt-out, unsubscribe, do-not-call, and similar requests; and
  • Maintain records reasonably necessary to demonstrate compliance.

You are solely responsible for your communications, offers, contracts, services, and dealings with any lead.

7. Lead Sellers and Contributors

If you submit or sell leads through the TML Leads Exchange, you represent and warrant that:

  • You collected the information lawfully;
  • You have the necessary authority and consent to share the information;
  • The information is accurate to the best of your knowledge;
  • You have not promised results, pricing, or services on behalf of the TML Leads Exchange;
  • The lead does not infringe another person’s rights; and
  • Your submission complies with these Terms and all applicable laws.

TML Leads Exchange may reject, remove, limit, suspend, or investigate any lead at any time.

8. Lead Quality and Disputes

Lead quality may vary. Unless a separate written agreement states otherwise, TML Leads Exchange does not guarantee that leads will be exclusive, complete, accurate, available, interested, qualified, or convertible.

If a lead appears to violate the applicable listing requirements, you must report it through [support contact or dispute process] within [number] days of receiving it. Any refund, credit, replacement, or other remedy is determined under the applicable offer, marketplace rules, or written agreement.

9. Payments and Fees

Certain services may require payment. Before completing a transaction, you will be shown the applicable price, fee, subscription, commission, or other charge.

You authorize TML Leads Exchange or its payment provider to charge the selected payment method for approved transactions. You are responsible for providing accurate billing information and paying all applicable taxes, unless stated otherwise.

Unless a refund is required by law or approved under a written refund policy:

  • Payments are non-refundable;
  • Fees may not be transferred or exchanged for cash;
  • Disputed transactions must first be raised with TML Leads Exchange; and
  • Unauthorized payment reversals or chargebacks may result in account suspension.

10. Prohibited Activities

You may not:

  • Use the website for fraud, deception, spam, harassment, or abuse;
  • Create multiple accounts to avoid restrictions;

12. User Content

You retain ownership of content and information that you submit, subject to the rights necessary for TML Leads Exchange to operate the marketplace.

By submitting content, you grant TML Leads Exchange a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, process, and distribute that content as reasonably necessary to provide, improve, secure, and promote the services.

You are responsible for ensuring that your content does not violate these Terms, applicable law, or another person’s rights.

15. Limitation of Liability

To the maximum extent permitted by law, Technovators Marketing Limited and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, loss of data, or reputational harm.

Our total liability arising from or related to the website or services will not exceed the amount you paid to TML Leads Exchange for the specific service giving rise to the claim during the [three/six/twelve] months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

16. Indemnification
